The Florida Attorney General's office has launched a criminal investigation into OpenAI, testing a legal theory with few precedents: whether an artificial intelligence system can be held liable as a principal in a violent crime. The probe stems from a 2025 mass shooting at Florida State University, where the suspect allegedly consulted ChatGPT in the days leading up to the attack. By investigating the platform's role, the state is exploring whether the model's responses crossed the line from automated information retrieval into criminal "counseling" — a distinction that, if upheld, would carry consequences far beyond a single case.

A Legal Framework Built for Humans
Aiding and abetting statutes in American criminal law were designed with human actors in mind. The concept requires, at minimum, knowledge of the criminal enterprise and some affirmative act that facilitates it. Courts have historically applied these standards to people — getaway drivers, lookouts, co-conspirators — whose intent can be inferred from behavior and context. Applying the same framework to a large language model, which generates responses through statistical pattern matching rather than deliberation, introduces a category problem that existing jurisprudence is not equipped to resolve cleanly.
Florida's approach is not entirely without precedent in spirit, though it is novel in target. Platforms have faced legal scrutiny before when their products were linked to user harm. Social media companies have been sued over algorithmic amplification of content tied to radicalization and self-harm. But those cases have largely proceeded under civil tort theories — negligence, product liability, failure to warn. A criminal investigation treats the matter differently. Criminal liability typically demands a higher evidentiary bar and, in most formulations, some element of mens rea — a guilty mind. Whether a probabilistic text-generation system can possess anything analogous to intent is a question that sits at the intersection of law, philosophy, and computer science.
OpenAI has maintained that while the shooting was a tragedy, the tool itself is not responsible. The company stated that it proactively shared account data with law enforcement and argued that the model merely provided factual, publicly available information without encouraging harm. For OpenAI, ChatGPT is a general-purpose utility — a mirror of the internet's vast data — rather than an entity capable of intent or criminal conspiracy.
The Precedent Problem
The investigation also raises a practical question about where the line falls for every other technology company. Search engines, forums, and online encyclopedias all surface information that could, in theory, be misused. If a state successfully argues that an algorithm can "abet" a crime based on the content of its outputs, the legal protections currently enjoyed by platform providers — including those rooted in Section 230 of the Communications Decency Act — may face new pressure. Section 230 shields platforms from liability for user-generated content, but its applicability to AI-generated responses remains an open and actively contested question. A chatbot does not host third-party speech in the traditional sense; it synthesizes and produces new text, blurring the distinction between platform and publisher that Section 230 was built around.
The political dimension is also difficult to ignore. State attorneys general have increasingly used high-profile investigations into technology companies as instruments of regulatory signaling, particularly in areas where federal legislation has stalled. AI governance remains fragmented in the United States, with no comprehensive federal statute governing the deployment of large language models. In that vacuum, state-level action — whether through consumer protection suits, data privacy enforcement, or, now, criminal investigation — fills a visible role.
The tension at the center of this case is structural. On one side sits a legal system that assigns culpability based on intent and agency. On the other sits a technology that produces outputs without possessing either. Whether Florida's investigation results in charges, a negotiated settlement, or quiet closure, the framework it tests will shape how legislatures, courts, and companies think about the accountability gap between what AI systems do and what the law was written to address.
